The Association of Sculptors of Victoria is an inclusive, not-for-profit collective of contemporary artists whose purpose is to inspire,stimulate and advance the appreciation, creation, and exploration of three-dimensional art in society.

President’s Message November and December 2009

This will be the last newsletter of this calendar year. We wish all members a merry Christmas and happy new year. Members may not realise that the time and trouble over the last year to amend the Constitution was in major part aimed at allowing exhibition organisers (Coordinators) to exercise more autonomy in their role, so it would be more attractive to them and encourage more to volunteer for the role and to maintain it for a few years. We are building up a broadly based team, where each exhibition or activity is run by an experienced organiser in his or her own style, subject to overall Committee review. We have been fortunate in the continuity of office holders, with Jenny running Herring Island (and a lot else until recently); Patrick running the Flower Show and finances; Mark running Tesselaar; Marija and Gillian picking up the Annual Exhibition again; Gillian a tower of strength in monthly activities; and Michael being the reliable back-stop for all. We still seek important new additions to the team: see Notices section below. Due to current shortages, and my own workload at this time of year, I am sorry that this edition has come out late. In future, the mail outs of the printed version of the newsletter may be held up pending someone volunteering to organize the printing and do the mail outs.

Members are also asked to look at the Notices section concerning the Services and Supply Directory, and email their comments to Gillian or Geoff.

International Notes below refer to some financially significant sales of sculpture during 2009. I find that a remarkable aspect of Jeff Koons is his ability to achieve such extraordinary financials without having to die first. Maybe his prior work as a Wall Street commodities trader helped.

ASV Recent Activities

ASV Monthly Meeting October 14: We were most privileged to have Deborah Halpern to talk to us about her sculpture. Deborah is best known for her sculpture „Angel‟ originally commissioned in 1987 for the south moat at the NGV, but has now been installed on the Yarra bank at Birrarung Marr - a spectacular site for what is one of Melbourne‟s most loved works of public art. Not only did Deborah explained at length the commission and the extraordinary challenges it presented she also showed slides of her painting, pottery, printmaking and sculpture and told of her love of art before and after “Angel.‟ Born into a family of artists, art became her life at a very young age and it was obvious throughout her talk the pleasure and passion she has had in creating this huge body of works that are both exuberant and whimsical. Although she is known throughout Australia and has had many overseas commissions she has a wonderful humble attitude to her achievements. Following her most interesting presentation we all enjoyed a very relaxed, informal chat over a cup of coffee. … Gillian Govan

ASV COMMITTEE MEETING: Summary Minutes of Meeting 4 November 2009

1. Treasurer report: Patrick has followed up his insurance claim for fire damage for the 2009 Annual Exhibition, and is waiting to hear back from assessor; Membership is well down with 35 or 36 people who haven't renewed however it is not unusual for some people to be late renewing; Member donations down on last year.
2. Tesselaar Sculpture Exhibition: Mark reported 58,000 visitors; it was won by Diane Thomson; Nichola Hoyle won People‟s Choice; 3 pieces were sold and 3 commissions were gained; there was less damage to sculptures this year; Tesselaar was pleased with the outcome and are keen to continue next year.
3. Annual Exhibition: Marija and Gillian have made submissions to Manningham and Glen Eira, for 2010 and 2011
4. Melbourne International Flower & Garden Show: Mark volunteered to assist Patrick with organising MIFGS 2010; helpers are needed for a subcommittee to review entries, and for bump in, layout etc.
5. Herring Island: Entry forms and conditions have been issued.
6. Policy and Procedures Manual: A start was made with a general page written by Leon, financial procedures drafted by Patrick, and a format suggested by Patrick. Subsequently it was agreed that Marija will work on Exhibition procedures with support from Michael
7. Services and Supplies Directory: The Committee was not in favour of continuing it, and a request for comment from members was agreed.
8. Personnel: Geoff stated he would continue the office of Newsletter Editor for the time being.
9. Membership: It was resolved that full year membership fees are to be paid in future by new members joining between 1 July and 31 December; half year membership fees are to be paid by new members joining between 1 January and 30 June; the discounted membership for January to June is for new members joining for the first time only.
10. Any Other Business:
a) GST and commission: it was resolved that the agreement on the revised GST and commission calculations be noted in the minutes.
b) Committee decisions by email: it was resolved that any decisions made by email between meetings be noted in the minutes of the next meeting.
11. Next Committee Meeting: 17th February 2010.

Warning to protect your Moral Rights

Many of you will know that Telstra are having Michael‟s work in their corporate office removed. An image of the work before removal can be seen at:

The Telstra work will be acquired by Grollo Australia and will be moved into storage on Dec. 5-6th. We do not know where it will go in the longer term and this will be worked out early next year. A good result considering.
The Telstra work's removal has highlighted a number of issues, partly because it was so integrated with the building that moving it is a major operation. It also pointed out the difficulties of dealing with an owner of a work who decided to get rid of the work and did not consult with the artist initially at the time of developing its plans. This has led to a very fraught situation where time was very short, the client was impatient, and the client was unwilling to do the removal in a way which would impact on the work as little as possible. Luckily a new owner has taken over the work and is removing it sympathetically.
Most situations are not quite so complicated, but artists need to be aware of their continuing rights over a work after they have sold it or delivered a commission.
The notion of moral rights was put into Australian law in 2000. This followed a long process of development and lobbying by many people and organisations, esp. NAVA and Artslaw. However, I can claim having started it when I introduced it to the Visual Arts Board in 1977-78 as a result of a few artists, including me, having been involved in a rather shonky gallery before this.
Moral rights are those rights which protect an artist's work and reputation. They are designed to make the public aware of the particular nature of art and to define the way art should be treated.
My recent episode with Telstra involved my art work being put in danger of being mutilated or destroyed, and I was forced to engage a specialist solicitor to help me fight Telstra. We succeeded and the work will now be removed properly and stored until a new venue can be found.

In another case, in Yarrawonga, the expression of interest in Yarrawonga was found at the last moment to have a clause which required the sculptor to pass over all rights in the work- ownership, copyright and to waive moral rights. I was told by the council officer that this was so they had the right to destroy the work in the future if they wanted to.
Ownership is normally passed over when a work is bought or commissioned. Transfer of copyright normally requires a separate agreement, and should not be done without very careful consideration. Waiving of moral rights is almost never done and should be avoided at all costs. It means that the owner can do anything with the work without the artist's control.

28 January 2010: Life Drawing: For interested members I have organised a Life Drawing class. I have arranged the class with the same tutor Effie Mandelos but in a different venue. Members who participated last time really enjoyed the class and those who didn't participate wished they had. So don't miss out this time.

Cost: 1-12 people $295.00. If full numbers will be $24.50 per person
12- 20 people $380 a 2nd tutor will be required to give good lesson this will work out at $19.00 per person if full class.
In other words the more students the cheaper per person.
Students can supply own charcoal , erasers and paper or they are available at venue for very good prices

1. History night- We have some interesting members who could tell us about the origins of the association; about some of the early members and the origins of our awards and sponsors. Photos and talk about past exhibitions

3. An information night on techniques: An interesting idea needing planning. Include safety issues
4. Venue: It was suggested we find a venue nearer the Bay. Any one prepared to do some scouting?
5. Bartering and swap meet: Unused tools, books, materials, memorabilia, Could be fun!

The Ian Potter Centre: NGV Australia: Federation Square: to 7 February 2010: The 2009 Clemenger Contemporary Art Award, a triennial exhibition and award, is on display. This is the final exhibition in the series of triennials established by Joan and Peter Clemenger through a generous gift to the NGV in 1991, and conceived as an invitational event. Each participating artist was provided with an honorarium to supplement expenses associated with creating new work. Providing this support in the research and development stage enabled artists to benefit by pushing work in unforeseen directions. Ah Xian has been awarded the 2009 prize of $50,000 for his work Concrete Forest. International Activities

Notes on International Sculpture Sales 2009: The Economist November 28th 2009 reviewed the international art market and noted that, despite the significant downturn following the longest bull run in a century of art market history, “there are still buyers in the market” (Special Report page 3). The biggest problem alleged is not 8 lack of demand but lack of good work to sell, due to little confidence in the market. The market is expected to bounce back, and attention is drawn to the key features involved:
Globalisation: a dramatic widening of the spread of market buyers geographically, with China now occupying third place after America and Britain, and more buyers from Russia, Asia and the Middle East;
Collectors and museums hanging on to older works, but great expansion in contemporary art (10% 1990s to 30% of Sotherby‟s revenues 2008);
Large increase in the number of museums in America, Europe, Middle East, Asia;
Large increase in number and diversity of private collectors, with particular interest in iconic works such as those of Jeff Koons.
In listing the top ten prices at auction year to date in 2009, The Economist included the following sculptures:
Constantin Brancusi: Madame L.R. 1914-17: $US 37.8m
Eileen Gray: Dragons Armchair 1917-19: $US 28.3m
Alberto Gicometti: L’Homme qui Chavire 1950-51: $US 19.3m
Edgar Degas: Petite Danseuse de Quatorze Ans 1922: $US 18.8m
In addition a special box on Jeff Koons noted a collector in 2008 offered over $US 80m for his Rabbit, and it was noted that some contemporary market insiders described him as one of the greatest sculptors of all time.

Obituary Notices for George Pryde and Bob Grant

Obituary Notice for Bob Grant

It is with great sadness that we learned of the death of Bob Grant on 10 December 2009. Bob had been suffering from cancer and had recently come out of hospital. Bob was an ASV member for many years and produced a large and consistent body of work. His specialty was Mt. Gambier limestone, working within the format of the largest standard building block. Within its parameters, he composed a wide range of imaginative, balanced, expressive and beautifully carved works which frequently were sold to enthusiastic purchasers. He demonstrated carving at MIFGS on a number of occasions and was ASV publicity officer for several years, being the first to properly utilise the new computer and email technology for the purpose.
Bob was a delightful, happy, friendly, helpful and smiling member and friend and we will miss his many attributes and cheerful face. Our sympathies go to Wendy, his great supporter, and to his family.

Obituary Notice for George Pryde
25/9/1916 – 16/7/2009
We were saddened to learn of the passing of George Pryde. George and his wife, Mabel, were members of the ASV from the early 1950‟s and he remained active until the late 90‟s, when he became ill and moved to Adelaide.
He produced a considerable body of work in the 50‟s and 60‟s, having several one man shows. He stopped sculpting in the 70‟s and became active in the ASV administration, being Treasurer for 25 years. Following the death of his wife, George provided the Annual Exhibition “Mabel Pryde Memorial Prize”, from 1990 to 2003, in memory of her contribution to the Arts. George‟s final activity at the ASV was the combined role of President, Treasurer and Exhibition Co-ordinator! He was made an Honorary Life Member and is well remembered for his enormous contribution to the development of the ASV and his unique gravelly voice.

Tax Deduction for Collectors of Art to 31 December 2009

Manyung Gallery is advising that their clients should seek the advice of their accountants in regard to the Government‟s 50% tax break to small business for the purchase of new artwork.
They state that under the Nation Building and Jobs Plan, the Government is offering Small and General Business Tax Breaks for the purchase of depreciable assets. This tax break is in addition to the annual deduction for depreciation that the business is entitled to claim for an eligible asset. The ATO has deemed artwork a depreciable asset under the scheme, providing it meets certain criteria. Jenny has been asking for some time for the appointment of a new controller of the ASV web site, and the development of a new ASV web site has accelerated the need for involvement of a person to manage it in future. Newsletter Editor and Assistant

Applicants are sought, and will receive every support with getting to know the ropes. Computer skills in MS Word or equivalent required for the Editor role. No computer skills required for assistance with mail outs. Apply to the Secretary please.

Services and Supplies Directory

The Committee believes that the great effort required by one or two very dedicated people in maintaining and updating this Directory (see www.francistaylor.com/directory ) is just not justified by the level of member use of it, due to the alternative use of search engines like Google. The software programming is efficient and sophisticated, and a lot of effort has been invested in setting up the data base, so it is a pity that more use has not been made of it. With the new web site coming onstream over the next few months the Committee did not believe that the Services and Supplies Directory could be justifiably continued and transferred to the new web site.
If you have views on this subject please communicate them to the Secretary at the address below before the next Committee meeting.

Warning on Internet Scams

Many members have received emails from a Jean Andre Akou purporting to be the chairman of a bank somewhere in Africa or the Middle East. Despite fears that the ASV database had been hacked into the fact is that these emails came through the email form on the web site so, if you don't reply then your email address is safe. Best to delete such scams immediately and thanks to all the members who alerted us.

Sculpture + the Enemies


SCULPTURE+ the enemies a new quarterly magazine.
Ours is the only magazine which focusses on Australian sculpture. Each exciting issue also includes an article on an Australian artist other than a Sculptor, who we refer to as the ‘esteemed enemy’. DURING THE MONTH OF MAY WE EXHIBIT CONTEMPORARY SCULPTURAL WORKS IN THE SHOP WINDOWS AND ON THE SIDEWALKS OF TOORAK RD. EACH YEAR IT CONTINUES TO GROW WITH INCREASED ENTHUSIASM FROM TRADERS, ARTISTS & THE PUBLIC THAT VIEW & BUY SCULPTURE.

2010 will be the 9th year OF the Toorak Village Sculpture EXHIBITION AND WE INVITE ALL EMERGING AND PROMINENT SCULPTORS TO SUBMIT ENTRIES FOR BOTH INTERIOR & EXTERIOR INSTALLATION.

· INTERIOR – SMALL TO MEDIUM SIZED FOR EXHIBITION IN SHOP WINDOWS & MUST BE DISPLAYED ON AN INDEPENDENT WHITE BASE (SUPPLIED BY ARTIST). REMEMBER OUR SHOP WINDOW SIZES DO VARY & THE SCULPTURES MUST SHARE WINDOW SPACE WITH SHOPS MERCHANDISE.

· EXTERIOR - LARGE SIZED, EXTREMELY ROBUST & ABLE TO BE FIXED/BOLTED TO FOOTPATH FOR INSTALLATION ALONG TOORAK ROAD. THERE WILL BE 8 TO 10 SITES AVAILABLE. SCULPTURE HEIGHT - UNDER 3M, WIDTH - VARIABLE, DEPTH – UNDER 60CM

CONSULTANT CURATOR – MALCOLM THOMSON, PRESENTLY CURATOR OF THE CLEMENT MEADMORE GALLERY AT THE AUSTRALIAN ACADEMY OF DESIGN WILL ASSIST THE EXHIBITION COMMITTEE WITH THE SELECTION OF SCULPTURE FOR THE 2010 EXHIBITION.

WE PLAN TO HAVE PRIZES OF $5,000, $2,500 & $1,000 FOR THE MOST INNOVATIVE SCULPTURAL WORKS, A PRESTIGIOUS OPENING IN THE TOORAK VILLAGE, A FULL COLOUR CATALOGUE, SIGNAGE, POSTERS & AN IMPRESSIVE MEDIA CAMPAIGN. ONCE AGAIN IT IS PROUDLY SUPPORTED & SPONSORED BY THE CITY OF STONNINGTON ALONG WITH TOORAK VILLAGE BUSINESSES.
